Terms & Condidtions

These Terms & Conditions apply to all offers, quotations, bookings, and agreements between Nola der Weduwe (hereinafter referred to as "the Photographer") and the Client.

1. Definitions

  • Photographer: Nola der Weduwe.

  • Client: the individual or legal entity entering into an agreement with the Photographer.

  • Photoshoot: the agreed photography session, event, or photographic assignment.

  • Agreement: the arrangement made between the Photographer and the Client.

2. Quotations & bookings

  • All quotations are non-binding and valid for 14 days unless stated otherwise.

  • A booking becomes confirmed once the Client has accepted the quotation or booking proposal, either in writing or verbally.

  • The Photographer reserves the right to decline a booking without providing a reason.

3. Payment & cancellation

  • Following confirmation of the booking, the Client will receive an invoice.

  • 50% of the total invoice amount must be paid no later than 7 days before the scheduled photoshoot or event, unless otherwise agreed in writing.

  • The remaining 50% must be paid within 3 days after the photoshoot or event, unless otherwise agreed in writing.

Cancellation policy

  • More than 14 days before the scheduled date: 15% of the total amount is due.

  • Within 14 days of the scheduled date: 50% of the total amount is due.

  • Within 48 hours of the scheduled date: the full amount is due.

4. Rescheduling

  • A photoshoot may be rescheduled once free of charge if requested at least 48 hours before the agreed date.

  • For outdoor sessions, a new date may be arranged in the event of unsuitable weather conditions.

  • In the event of illness or force majeur affecting the Photographer, the session will be rescheduled at no additional cost.

5. Photography services

  • The Photographer will carry out the assignment to the best of her ability and professional judgment.

  • The Client acknowledges being familiar with the Photographer's style as presented on her website, portfolio, and social media platforms.

  • Photography is a creative service. The final selection, editing, composition, and artistic decisions remain at the discretion of the Photographer.

  • Specific poses, images, moments, or outcomes cannot be guaranteed.

6. Delivery

  • Final edited images will be delivered within the timeframe communicated during the booking process, unless otherwise agreed.

  • Images will be delivered digitally via an online gallery or download link.

  • The number of delivered images depends on the selected package.

  • RAW files and unedited images will not be provided.

  • The Photographer will retain copies of the delivered images for up to three months after delivery. After this period, the Client is responsible for maintaining their own backups.

7. Editing

  • All images are carefully selected and edited in the Photographer's style.

  • Additional editing requests may incur extra charges.

  • Clients may not apply filters or substantially alter the delivered images without prior permission from the Photographer.

8. Copyright & Usage

  • Copyright of all photographs remains with the Photographer at all times.

  • The Client receives a non-exclusive licence to use the delivered images for personal purposes, including printing, sharing with family and friends, and posting on personal social media accounts.

  • Images may be shared on social media provided that the Photographer is credited where possible.

  • Commercial use, publication, resale, or third-party use of images requires prior written permission from the Photographer.

9. Portfolio & promotional use

  • Images will only be used on the Photographer's website, portfolio, social media, exhibitions, competitions, or other promotional materials with the Client's explicit consent.

  • Permission for image use will be discussed prior to or during the booking process.

  • Declining permission for promotional use will not affect the service provided or the delivery of images.

10. Liability

  • The Photographer shall not be liable for indirect damages, consequential losses, loss of income, or missed opportunities.

  • Liability is limited to the total amount paid by the Client for the relevant assignment.

  • In the unlikely event of equipment failure, data loss, illness, accident, or circumstances beyond reasonable control, the Photographer will make every reasonable effort to provide a suitable solution.

11. Complaints

  • Any complaints regarding the services provided or images delivered must be submitted in writing within 14 days of delivery.

  • The Photographer will make reasonable efforts to resolve any justified complaint in a fair and professional manner.

12. Final Provisions

  • These Terms & Conditions are governed by Dutch law.

  • Any disputes arising from these Terms & Conditions shall be submitted to the competent court in the Netherlands.

  • By confirming a booking, the Client agrees to these Terms & Conditions.
